There is no grace period for a household moving from one subsidized property to another; subsidy may not start in a new unit and property until the day after the end of subsidy in the old unit and property. NEAHMA is excited to offer a webinar designed to help Owners and Agents resolve Double Subsidy Issues. The use of lead-safe work practices makes the job safer and reduces your liability exposure.\nEPA’s Renovation\, Repair and Painting Final Rule (40 CFR 745) regulations now require that renovations conducted for compensation\, must be performed by Certified Firms using Certified Renovators. Renovation firms that wish to work in pre-1978 homes and child-occupied facilities must apply to EPA and pay a fee in order to become certified. Renovators seeking to become Certified Renovators must successfully complete a EPA-accredited renovator course. Each company will be required to have at least one certified technician on-site by law. This includes work done in residential homes\, apartments\, or child-care facilities built pre-1978. For those in violation of this law there is tremendous liability and penalties are now being enforced. HUD has provided tools and guidance to Owners with the expectation of reducing assistance payment errors\, mismanagement and/or fraud. Throughout this course\, we will review the requirements detailed in Chapters 8 and 9 of the Handbook\, which address the actions that Owners must\, should and may take upon discovering a discrepancy and/or possible error that affects a tenant’s rent and/or eligibility. Next\, HUD has very specific requirements regarding tenant and/or Owner repayment agreements. We will detail these requirements as well as provide guidance on successfully negotiating and entering into a repayment agreement with a tenant. Additionally\, HUD recognizes the financial and administrative burden of investigating and documenting discrepancies and/or possible errors. We will review the guidance in the Handbook stating that Owners may retain a portion of the repayments they collect from tenants to defray the cost of pursuing these cases. Finally\, throughout this course we will use a case study to highlight HUD’s requirement of investigating and documenting discrepancies and/or possible errors and entering into repayment agreements with tenants in order to reimburse HUD for improper subsidy payments.
